What is surrogacy? Its types and rules in hindi.

सरोगेसी एक ऐसा शब्द है जिससे कही न कही  शायद हम सभी परिचित है | सरोगेसी चिकित्सा से सम्बंधित एक ऐसी तकनीक है जिसमे कोई महिला अपनी कोख से किसी दूसरे दंपति या व्यक्ति के लिए बच्चा पैदा करती  है | 

आज के समय में सरोगेसी से बच्चे पैदा करना भी  फैशन का ही एक हिस्सा बन गया है | वे पुरुष और महिलाएँ जो शादी नहीं करना चाहते या वे महिलाएँ जो शारीरिक और मानसिक कष्ट से बचना चाहती है वे भी सरोगेसी का सहारा लेती है | 

सरोगेसी क्या है ?

सामान्य शब्दों में सरोगेसी का मतलब है शिशु के जन्म तक एक महिला की " किराये की कोख " | वैसे तो सरोगेसी की मदद तब ली जानी  चाहिए जब वास्तविक रूप से दंपती को बच्चे को जन्म देने में कठिनाई आ रही हो या बार बार गर्भपात हो रहा हो या IVF तकनीक भी असफल हो रही है | 

सरोगेट मदर :-

वह महिला जो किसी दंपति के बच्चे को अपनी कोख में जन्म देने को तैयार हो जाती है उसे सरोगेट मदर कहते है| 

सरोगेसी के प्रकार:- 

सरोगेसी दो प्रकार की होती है 

• व्यवसायिक सरोगेसी :-

जब सरोगेट मदर कोई परिवार की सदस्य या कोई रिश्तेदार नहीं होती है | और किसी मोटी रकम या किसी महँगी वस्तु के बदले अपनी कोख को किराये से देती है | 

• नैतिक सरोगेसी :-

इसमें सरोगेट मदर कोई नजदीकी रिश्तेदार या परिवार की सदस्य ही होती है तथा इसमें कोई आर्थिक सहायता नहीं होती है केवल परोपकार के लिए अपनी कोख को किराये से देती है | 

एजेन्सिया  :-

सरोगेसी की सुविधा कुछ विशेष एजेंसियो  द्वारा उपलब्ध कराइ जाती है इन एजेंसियो को आर्ट क्लिनिक कहते है जो इंडियन कॉउंसिल ऑफ़ मेडिकल रिसर्च (ICMR) के नियमो का पालन करती है 

ART उद्योग में लगभग 25 अरब रूपये का सालाना कारोबार होता है | जिसे विधि आयोग ने स्वर्ण कलश की संज्ञा दी है |

सरोगेसी के लाभ :-

• इससे निसंतान दम्पतिओं को संतान मिल जाती है | 
• व्यवसायिक सरोगेसी में सरोगेट मदर को आर्थिक सहायता मिल जाती है | 
• पहले निसंतान दम्पतिओं के पास सिर्फ बच्चो को गोद लेने का ही एक मात्र विकल्प मौजूद था | अब एक से ज्यादा  विकल्प है | 
• भारत में सरोगेसी का खर्चा अन्य देशो की तुलना में बहुत कम है इसलिए भारत सरोगेसी के क्षेत्र में एक केंद्र बनकर उभरा है | 

सरोगेसी से हानियाँ :-

• सरोगेसी से जन्मे बच्चो को त्यागने सम्बंधित सूचनाएं मिली है | 
• इससे जन्मे बच्चों के अधिकार सुरक्षित नहीं होते हैं | 
• सरोगेट मदर के अधिकार सम्बंधित कोई स्पष्ट उल्लेख नहीं है | 
• सरोगेसी से पैदा हुए बच्चों के शोषण की सम्भावना बढ़ी है | 
• इस से गोद लेने का प्रचलन कम हो गया है | 

हाल ही में लोकसभा में पारित हुए सरोगेसी कानून 2019 के विषय में फिर से चर्चा शुरू हो गई है |  इस कानून में व्यसायिक सरोगेसी पर रोक लगाने , राष्ट्र और राज्य स्तर पर इसके बोर्ड का गठन करने , तथा सरोगेसी की गतिविधियों और प्रक्रिया के लिए उपयुक्त अधिकारियों की नियुक्ति का प्रावधान किया गया है |  इस विषय पर गंभीरता से विचार किये जाने की आवश्यकता है ताकि इसके दुरुपयोग  को रोका जा सके |

Surrogacy is a word with which we are probably all familiar. Surrogacy is a technique related to medicine in which a woman produces a child for another couple or person from her womb.

In today's time, having children with surrogacy has also become a part of fashion. Men and women who do not want to get married or women who want to avoid physical and mental suffering also resort to surrogacy.

What is surrogacy?

In general terms, surrogacy means a woman's "rented womb" until the birth of the baby. By the way, surrogacy should be taken when the couple is actually having difficulty giving birth or having frequent miscarriages or failing the IVF technique.

Surrogate Mother: -

The woman who is ready to give birth to a couple's child in her womb is called a surrogate mother.

 Types of Surrogacy: -

There are two types of surrogacy.

Occupational Surrogacy: -

When a surrogate mother is not a family member or a relative. And in exchange for a hefty amount or an expensive item, She gives her womb for rent.

Ethical Surrogacy: -

In this surrogate mother is a close relative or family member and does not have any financial support, only rents her womb for charity.

Agency: -

Surrogacy facility is provided by some specialized agencies. These agencies are called Art Clinics which follow the rules of the Indian Council of Medical Research (ICMR).

The ART industry has an annual turnover of about 25 billion rupees. Which the Law Commission has called the Golden Kalash.

Benefits of Surrogacy: -

• This gives children to childless couples.
• In commercial surrogacy, the surrogate mother receives financial assistance.
• Earlier, childless couples had only option to adopt only children. Now there is more than one option.
• The cost of surrogacy in India is very low compared to other countries, so India has emerged as a center in the field of surrogacy.

 Losses from surrogacy: -

• Information related to abandonment of surrogacy-born children has been received.
• The rights of children born to it are not protected.
• There is no explicit reference to the rights of surrogate mother.
• The possibility of exploitation of children born with surrogacy has increased.
• This has reduced the adoption trend.

Discussion has started again about the recently passed Surrogacy Act 2019 in the Lok Sabha. The law provides for the prohibition of commercial surrogacy, the formation of its board at the national and state levels, and the appointment of appropriate officers for the activities and procedures of surrogacy. This subject needs serious consideration so that its misuse can be prevented.
